With the growth in short term vacation home rentals (property rentals that are typically considered to be less than 6 month rental terms), many governmental agencies have placed restrictions or bans on vacation rentals. Unless deed restricted, property rights advocates argue that long and short term rentals are a property ownership right and that length of rental term does not change property use from residential to a zoning restricted commercial use.
As professional vacation rental property managers, industry stakeholders and associations like the Vacation Rental Managers Association (VRMA) seek to establish good neighbor polices, guidelines and practices, some municipalities have implemented restrictions such as license requirements and standards of short term rental practice. These regulations are often looked upon favorably by professional managers, protecting property owner rights and beneficial to the industry.
Complex legal arguments will continue as the courts make decisions that affect the industry and rights of property owners.
A federal court in Hawaii has tossed out a local zoning initiative that attempted to limit vacation rentals in a ruling that may cause other resorts and vacation destinations in the United States to sit up and take notice. Read more here
